Purpose and acceptance
Browsing the web page www.whalewise-ecotours.com, property of WWET involves the users to accept all the dispositions included in this legal notice, which can be modified. Furthermore, the users recognize and accept the access and the use of the web site, and all its contents, under their own responsibility.
The user shall agree to make a correct and licit use of the web site and its contents, in accordance with the applicable law, the present legal notice, the good will, the good manners commonly accepted by the public order, and the traffic law. Meaning that the user will have to respond in front of WWET and in front of third parties, for the damages and harm caused as consequence of breaching the obligations described.
The reservations made through this web site, and through other channels of booking, are subjected to the acceptance of this terms and conditions. If the user does not agree with the clauses, it is requested to stop de reservation process. If the reservation is complete, the user accepts to have read and accepted the conditions of use. If there is any part that the user does not understand, or if there is any question, please email us or call us.
Ir order of proceed and guaranty your reservation, it is requested to PAY to total amount of the reservation.
In accordance with the law (Ley 7/1995, de 6 de abril, de Ordenación del Turismo de Canarias) WWET provides the following information to users and pertinent entities:
Reservations can be modified or cancelled with an anticipation greater tan 48 hours before the departure time of the tour booked, except for those tours with non refundable policy (which will be announced prior to the payment of the reservation)
In the case of reservations of Private, Special, or Thematic Tours, and all tours that involve the booking of the entire vessel, the modifications and cancellations can be made within a period of time greater than 5 days prior than the serviced booked.
WWET will NOT REFUND the 50% of the payment for the reservations cancelled in a period of time inferior than 48 hours. Cancellations must be notify via email to email@example.com, or by phone call or wasp to +34 627 69 70 70.
IN cases of NOT SHOWING UP at the vessel, or the pick up location, and no notifications received, WWET will NOT REFUND the payment.
The vessel is limited to 10 passengers, under no circumstance WWET will admit further passengers.
CHANGES OF CONDITIONS:
WWET has the right to modify or to cancel tours, without previous notice, under the following circumstances:
- Adverse weather conditions
- Not covering the minimum of 4 passenger per trip (except for private tours)
- Exceeding the maximum occupancy of 10 passengers.
- Any other circumstance beyond our control.
Under all these circumstances WWET will refund the 100% of the reservations.
WWET also has the right to modify this terms and conditions without notice and at any time. The use of this web will also be subjected to the general conditions in law at the time of use.
GUARANTEE OF SIGHTING CETACEANS:
In case that NO CETACEANS are encountered and this posibility was not notified prior to embarking by our crew, WWET offers to repeat the same tour for FREE. Under no circunstance WWET will refund the payment of the tickets.
CONDITIONS ON BOARD OUR VESSEL:
All our passengers are covered with a full accident and liability insurance.
The captain on board is the authority figure, having the right and the obligation to modify the conditions and actions as required. All passengers must follow his/her orders at all times.
WWET is not responsible for any damaged or lost personal items on board.
On board our vessel, it is forbidden any unsafe, violent or abusive behaviour. In such cases, legal actions will be taken as required.
Conditions of access and use of the website
WWET may establish limitations and / or additional conditions for the use and / or access to the Website and / or content, which must be observed by users in any case.
WWET does not guarantee the availability and continuity of the operation of the Website or of those other websites with which a Link has been established. Also, WWET will not be in any case responsible for any damages that may arise from the lack of availability or accessibility to the website, for the interruption in the operation of the website or computer failures, telephone breakdowns, disconnections, delays or blockages caused for deficiencies or overloads in telephone lines, in the Internet system or in other electronic systems produced in the course of its operation.
The website and its services are free and open access, however, WWET conditions the use of some of the services to the previous completion of the corresponding form. The user guarantees the authenticity and updating of all data communicated to WWET and will be solely responsible for any false or inaccurate statements made.

Introduce into the network computer viruses or perform actions that may alter, spoil, interrupt or generate errors or damage to electronic documents, data or physical and logical systems of WWET or third parties; as well as hinder the access of other Users to the Website and its services through the massive consumption of computer resources through which WWET provides its services. Try to access the email accounts of other users or restricted areas of WWET or third-party computer systems and, if necessary, extract information. Infringe the rights of intellectual or industrial property, as well as violate the confidentiality of the information of WWET or of third parties. Impersonate the identity of another User, public administrations or a third party. Reproduce, copy, distribute, make available or otherwise publicly communicate, transform or modify the Contents, unless you have the authorization of the owner of the corresponding rights or it is legally permitted. Collect data for advertising purposes and send advertising of any kind and communications for sale or other commercial purposes without your prior request or consent. Protection of Data and Services.

WWET makes photo reports and videos of the tours for advertising and commercial purposes. If any customer is identified and wishes to request the withdrawal of a certain photograph, and wishes their removal, you must contact us with indications of the image (s), and we will proceed to remove them.
